    CITY OF NAPLES FEES FOR PUBLIC RECORDS
    Res. No. 13-13241, adopted February 6, 2013 , as amended

    In accordance with F.S. § 119.07(4), the following fees shall be charged for public records. If no fee is otherwise prescribed by law, then the custodian of the public record shall furnish a copy or certified copy of the record upon payment of the applicable fee.

    The following terms apply:

    "Actual cost of duplication" : The cost of the material and supplies used to duplicate the public record, but does not include labor cost or overhead cost associated with such duplication. (F.S. § 119.011(1))

    "Duplicating" : The process of reproducing an image or images from an original to a final substrate through the electrographic, xerographic, laser, or offset process of or any combination of these processes, by which an operator can make more than one copy without re-handling the original. (F.S. § 119.011(7) and F.S. § 283.30(13)).

If the nature or volume of public records requested to be inspected, examined, or copied is such as to require extensive use of information technology resources, or extensive clerical or supervisory assistance by personnel of the city, or both, the city may charge, in addition to the actual cost of duplication, a special service charge, which shall be reasonable, and shall be based on the cost incurred for such extensive use of information technology resources or the labor cost of the personnel providing the service that is actually incurred by the agency or attributable to the agency for the clerical and supervisory assistance required, or both.

    f.

    The special service charge under e. will not be charged unless the estimated time for fulfilling the request exceeds 60 minutes.

    Such charges shall be based upon the actual labor (the hourly salary plus benefits of the lowest paid employee capable of performing the task).

    (a)

    General customers connected to the reclaimed water system shall pay a reclaimed water base rate based on the equivalent residential unit as determined by the size of the reclaimed water meter serving the property as follows:

    (c)

    Sewer consumption rates for single-family residential customers without a potable water irrigation meter or reclaimed water meter or sub-meter shall be capped at 10,000 gallons per month.

    (d)

    Sewer consumption rates for multifamily residential customers without a potable water irrigation meter or reclaimed water meter or sub-meter shall be capped at 10,000 gallons per month per dwelling unit.

    (e)

    Sewer consumption rates shall not be applicable to the use as measured by a potable water irrigation or reclaimed water meter.

    (f)

    The sewer consumption rate shall be $4.03 per 1,000 gallons for all customer classes.

    b.

    Multi-users. Offices and businesses sharing a container for refuse type I with others will be charged their prorated share of the rate based on the size of container and number of pickups per week as determined by the city manager.

    c.

    Change in level of service; size of containers. The level of service insofar as it relates to the size of container and frequency of collection per week may not be changed more than two times per 12-month period and not closer together than a four-month period of time between changes in level of service. Such change shall be effectuated by the owner/operator executing proper forms provided by the city and making payment of a $50.00 fee for effectuating such change; provided, however, that under no circumstances may the level of service and the bi-monthly charge therefore be reduced below the minimum level of service and charge therefore set forth above.

    d.

    New accounts. Billing will commence on new services when an occupancy permit is issued or when the sewer service charge begins, whichever is sooner.

    e.

    Compactor and open-top roll-off container servicing. Commercial properties maintaining self-contained or break-away compactors that use roll-off containers shall be charged $246.14 per pick-up plus actual disposal fees charged by the Collier County Landfill. The city manager will establish a specific date within two business days from the customer's request for collection. Customers shall place all bulk waste curbside for collection no sooner than 24 hours prior to the prearranged collection date. Collection services for bulk waste shall incur a service charge of $15.37 per cubic yard for collection and disposal with a $50.00 minimum charge.

    b.

    Front loading containers with compactors shall be charged 3 times the rate in subsection (4) a corresponding to the size and pickup rate.

    Single-use roll-off containers or compactors shall be charged their prorated share of disposal fees charged to the city by the county based on the current disposal rate per ton off-loaded at the Collier County Landfill.

    d.

    Disposal for residential collection services shall be $6.08 per month.

    e.

    Disposal for commercial and multifamily roll cart container services shall be $12.90 per month.

    (5)

    Excess waste in containers. Solid waste placed in containers may not exceed the height of the container. Placing excess waste in containers shall result in a written warning. The second violation shall result in an automatic $50.00 surcharge. Subsequent violations shall result in container size or frequency of collection being automatically increased in order to provide sufficient service.

    (6)

    Collection and processing of residential single stream recyclables. Minimum rates per year include a city-provided roll cart and 1 pickup per week:

    (7)

    Collection and disposal of incidental amounts of refuse type III C&D debris. Upon notification from a resident of incidental amounts of C&D debris generated by the resident on their own property, at the discretion of the city manager, the city may choose to collect such materials, pursuant to section 32-34. C&D debris may include cabinets, wood, drywall, plumbing fixtures and other demolition type debris. All loose materials must be in containers, or bags that weigh less than 30 pounds each. No loose piles of material will be collected. The city reserves the right to pick up only those items which employees and equipment are able to safely and effectively collect and dispose. Material approved for collection must be placed curbside no more than 24 hours prior to scheduled collection. Collection services for refuse type III shall incur a service charge of $15.37 per cubic yard for collection and disposal fee, with a $50.00 minimum charge.

    Chapter 36. Traffic and Vehicles

    § 36-105. Permit parking in city-owned parking lots or garages, permits for launching of vessels, and permits for loading and off-loading of construction material at Naples Landing Park.

    The issuance of any new license will reflect a base rental rate fee calculated and inclusive of the most recently adjusted rate and be effective at the time of license execution. This provision will apply to any current commercial tenant of the city dock receiving a new license consideration by the city.

    (g)

    The issuance of any new license may include an optional discount of a rental fee waiver of up to 30 days at the time of license execution to be applied to the first month slip rental.

    (h)

    The issuance of any new license resulting from a tenant referral may include an optional discount of a rental fee waiver of up to 30 days at the time of license execution to be applied to the next month slip rental of the tenant making the referral.

    (2)

    Fuel mark-up.

    (a)

    The formula for calculating the fuel mark-up to establish retail prices charged at the Naples City Dock on deliveries from fuel suppliers, and to establish the allowable mark-up range on wholesale delivered fuel is hereby adopted as follows:

    1.

    All applicable federal, state and special excise gas taxes, and all current Collier County local option fuel taxes shall be added to the base price of all wholesale delivered fuel;

    2.

    A mark-up of not less than 10% nor greater than 40% shall be added to each gallon of fuel sold at the Naples City Dock, based upon retail price, including all discounts, remaining competitive with the surrounding marine retailers.
